How the proxy must be made to participate in the assembly of the condominium.<\/h2>\n

Anyone entitled to\u00a0participate\u00a0in the condominium assembly\u00a0<\/strong>must be informed in time of the conduct of the meeting (see articles 1136 cc and 66 disp. Att. Cc).<\/p>\n

Specifically, whether it is a face-to-face meeting or videoconference, it is well known that the notice must be received – this is the meaning of the term ”\u00a0press release\u00a0<\/strong>” inserted in art.\u00a066 avail.\u00a0att.\u00a0cc – at least five days before the date set for the meeting.<\/p>\n

Inciso: entitled is a broader term than the classic one of condominium in force before the reform of the condominium (l n. 220\/2012).<\/p>\n

This could mean that the legislator intended to broaden the number of subjects that the\u00a0administrator must summon\u00a0: not only the\u00a0owners\u00a0<\/strong>but, when they have the right, also the tenants (eg on the use of heating).<\/p>\n

We will see what will be the jurisprudential orientation on the matter, while the doctrine has held that there are no differences whatsoever, or at least such as to make the\u00a0tenant\u00a0<\/strong>also be considered included in the group of entitled persons\u00a0.<\/p>\n

Let’s go back to the\u00a0focus\u00a0<\/em>: participation in the assembly by\u00a0proxy\u00a0<\/strong>.<\/p>\n

In any case, whoever is entitled to participate, he can do so in two ways:<\/p>\n
